Terms of Use — Yield

Acceptance of Terms

These Terms of Use govern your access to and use of the Yield mobile application, developed and operated by Entrain Apps. By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

By accessing or using Yield, you confirm that you are at least 18 years old and that you have read, understood, and agree to be bound by these Terms. If you are using the App on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

Description of the Service

Yield is a workout planning and tracking application that allows users to create training protocols, log exercises, and track progress. The App includes AI-powered features that generate training protocols and provide in-workout guidance. For users with a connected Apple Watch, Yield optionally uses real-time heart rate data to guide rest periods between sets.

AI-Generated Content Disclaimer

Yield uses artificial intelligence provided by Anthropic's Claude API to generate training protocols, exercise recommendations, coaching cues, and other workout-related content. You acknowledge and agree that:

AI-Generated Content is not medical advice. Training protocols, exercise suggestions, and coaching cues are generated by an AI model and are not reviewed, verified, or endorsed by certified personal trainers, physicians, physical therapists, or any other licensed health or fitness professionals.
AI-Generated Content may contain errors. AI models can produce inaccurate, incomplete, or inappropriate recommendations. Exercise descriptions, rep schemes, weight suggestions, and coaching cues may not be suitable for your individual fitness level, physical condition, or goals.
You are solely responsible for evaluating AI-Generated Content before following any recommendation. You should apply your own judgment and, when in doubt, consult a qualified professional.
We make no warranties regarding the accuracy, safety, completeness, or suitability of any AI-Generated Content for any particular purpose.

Health and Fitness Disclaimer

Consult your physician before beginning any exercise program. Yield is a planning and tracking tool, not a substitute for professional medical or fitness guidance.

You acknowledge and agree that:

You should obtain medical clearance from a qualified healthcare provider before starting any new workout program, particularly if you have any pre-existing medical conditions, injuries, or health concerns.
Physical exercise carries inherent risks, including but not limited to musculoskeletal injury, cardiovascular events, and overtraining. You voluntarily assume all risks associated with physical exercise and use the App entirely at your own risk.
You are responsible for selecting appropriate weights, exercises, and intensities for your individual capabilities. The App cannot assess your physical condition, injury history, or readiness to perform any given exercise.
You should stop exercising immediately and seek medical attention if you experience pain, dizziness, shortness of breath, or any other concerning symptoms during a workout.
We are not liable for any injury, health complication, or damage resulting from your use of the App or reliance on any content provided through the App.

User Conduct

When using Yield, you agree to:

Use the App only for its intended purpose of workout planning and tracking.
Not attempt to reverse-engineer, decompile, disassemble, or otherwise derive the source code of the App.
Not use the App to generate content that is unlawful, harmful, abusive, or otherwise objectionable through the AI features.
Not interfere with or disrupt the operation of the App or any servers or networks connected to the App.
Not use automated means — bots, scrapers, or similar tools — to access the App or its features.

Intellectual Property

All content, features, functionality, design, code, trademarks, and other intellectual property associated with Yield are owned by Entrain Apps or its licensors and are protected by applicable intellectual property laws. These Terms grant you only a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.

The training protocols and workout data you create using the App remain yours. However, by using the AI features, you acknowledge that AI-Generated Content may be similar to content generated for other users, and you do not acquire exclusive rights to any AI-Generated Content.

Third-Party Services

Yield integrates with the following third-party services:

Anthropic (Claude API)

Used to power AI-driven protocol creation and in-workout guidance features. Your use of these features is subject to Anthropic's terms and policies. We are not responsible for the availability, accuracy, or practices of Anthropic's services.

ExerciseDB

Used to retrieve exercise reference images. Your use of these features is subject to ExerciseDB's and RapidAPI's terms and policies.

These integrations may change or become unavailable at any time without notice.

Data and Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we handle your data. By using the App, you agree to the practices described in the Privacy Policy.

Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ENTRAIN APPS, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

PERSONAL INJURY OR PHYSICAL HARM ARISING FROM YOUR USE OF THE APP OR RELIANCE ON AI-GENERATED CONTENT;
LOSS OF DATA, PROFITS, OR GOODWILL;
COST OF SUBSTITUTE GOODS OR SERVICES;
ANY MATTER BEYOND OUR REASONABLE CONTROL.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US, IF ANY, FOR ACCESS TO THE APP DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Indemnification

You agree to indemnify, defend, and hold harmless Entrain Apps and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your use of the App, your violation of these Terms, or your violation of any rights of another person or entity.

Changes to These Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will update the "Last Updated" date at the top of this document and may notify you through the App. Your continued use of the App after any changes constitutes your acceptance of the updated Terms.

Termination

We may suspend or terminate your access to the App at any time, for any reason, without notice or liability. You may stop using the App at any time. Upon termination, all provisions of these Terms that by their nature should survive will survive, including intellectual property provisions, disclaimers, limitations of liability, and indemnification.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Minnesota, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of Hennepin County, Minnesota.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.

Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Entrain Apps regarding your use of the App and supersede all prior agreements and understandings, whether written or oral.
